Alternative Dispute Resolution, or ADR, may be generally described as the process of resolving disputes without participating in a formal trial setting in a court at law. Advantages of ADR include saving time and money, confidentiality, preservation of relationships, and reduced stress. ADR includes two distinctly different processes, namely mediation and arbitration.
Mediation is a voluntary process through which a neutral third party helps two or more different parties achieve a resolution to one or more issues. The mediator assists in negotiating difficult issues and disputes that arise between the parties primarily by bridging the communication gap between the parties. Mediation allows the parties to design their own solution and most disputes that are addressed through mediation reduce the cost and time of litigation. Our firm has highly trained specialists in the mediation field. We mediate disputes in all areas of the law, including family, business, church, health care and employment.
Arbitration, by contrast, is the private, judicial determination of a dispute, by an independent third party. Arbitration is often required by contracts that create the original relationship between disputing parties. All arbitration results in binding awards, unless the parties agree to advisory arbitration. If the agreement says "arbitration," without any modifier, the decision is binding. The parties to an arbitration agreement can, however, mutually agree to withdraw the case from arbitration at any time before an award is issued by the arbitrator. If they withdraw the case the arbitrator loses the authority to decide the case.
